1. Acceptance of Terms
By accessing and using DigitalScan.ai ("the Platform"), operated by FullScan Technologies ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Service Description
DigitalScan.ai provides AI-powered background verification services for employers and HR teams in India. The Platform accesses government databases and authorized APIs to verify identity, employment history, legal records, and other candidate information on behalf of registered organizations.
3. Candidate Consent Requirement
You represent and warrant that:
- You have obtained explicit, informed, written consent from each candidate before initiating any background verification through the Platform.
- The consent clearly informs the candidate that their personal data (including PAN, Aadhaar, employment history, court records, etc.) will be verified through government databases and third-party APIs.
- The consent complies with the Digital Personal Data Protection Act, 2023 (DPDP Act), and any other applicable Indian law.
- You maintain records of such consent and will produce them if required by us, regulatory authorities, or the candidate.
- You will not use the Platform to conduct unauthorized surveillance, harassment, or verification of individuals who have not consented.
⚠️ Important: Conducting background verification without candidate consent is a violation of Indian privacy law and these Terms. Violations will result in immediate account termination and may be reported to authorities.
4. Data Protection & Privacy
- All personal data processed through the Platform is encrypted at rest and in transit.
- We act as a Data Processor on your behalf. You remain the Data Fiduciary responsible for lawful collection and use of candidate data.
- We do not share candidate data with any third party except the authorized verification APIs (SurePass / Government databases).
- Data retention follows a strict policy: verification results are cached for operational efficiency and automatically purged per our retention schedule.
- Candidates have the right to access, correct, or request deletion of their data. You must facilitate such requests.
5. Permitted Use
The Platform may only be used for:
- Pre-employment background verification with candidate consent
- Periodic re-verification of existing employees (with consent)
- Vendor/contractor verification as part of due diligence
Prohibited uses include: personal surveillance, tenant screening without legal basis, debt collection, or any use not authorized by the candidate.
6. Account & Billing
- Each organization is a separate tenant with isolated data.
- You are responsible for managing user access within your organization.
- API calls and report generation are billed per the pricing schedule agreed at signup or as displayed in the billing section.
- Prepaid credits are non-refundable unless required by law.
7. Accuracy & Disclaimer
- Verification results are sourced from government databases and may contain errors or delays inherent to those systems.
- We do not guarantee 100% accuracy of any verification result.
- You should not make adverse employment decisions solely based on automated verification without human review.
- Reports are for informational purposes and do not constitute legal advice.
8. Limitation of Liability
To the maximum extent permitted by law, FullScan Technologies shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform, including but not limited to incorrect verification results, service downtime, or data breaches caused by third-party API providers.
9. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, particularly the candidate consent requirement. Upon termination, your data will be retained for 90 days for compliance purposes and then permanently deleted.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
